Motivos: DEFECTOS O MOTIVOS 01) El nombre comercial solicitado se halla incurso en la prohibición del art. 5.1.b) en relación con el art. 88.b) de la Ley de Marcas (Ley 17/2001, de 7 de diciembre). De la aplicación conjunta de ambos artículos se deriva que no podrán registrarse como nombre comercial los signos que carezcan decarácter distintivo.En concreto, el signo solicitado carece de carácter distintivo, el signo solicitado carece de carácter distintivo, por consistir exclusivamente en términos descriptivos en relación con los servicios solicitados que no permitirán al consumidor identificar dicho signo con una concreta procedencia empresarial. 02) El nombre comercial solicitado se halla incurso en la prohibición del art. 5.1.c) en relación con el art. 88.b) de la Ley de Marcas (Ley 17/2001, de 7 de diciembre). De la aplicación conjunta de ambos artículos se deriva que no podrán registrarse como nombre comercial los signos descriptivos, es decir, aquellos que se compongan exclusivamente de signos o indicaciones que puedan servir en el comercio para designar la especie, la calidad, la cantidad, el destino, el valor, la procedencia geográfica o la época de obtención del producto o de la prestación del servicio u otras características de los productos o servicios a los que se refieran las actividades solicitadas.En concreto, el signo solicitado se compone exclusivamente de términos que hacen referencia a la finalidad de los servicios para los que se solicita el nombre comercial, teniendo en cuenta que se traduce como "subastas de arte". 03) POR OPOSICION BASADA EN:- <a href="/distintivo/art-auctions-barcelona/oepm/m-4303057/" title="Detalle de la marca ART AUCTIONS BARCELONA">ART AUCTIONS BARCELONA</a>ART AUCTIONS BARCELONA- Articulo 10.
